Distance Makes a Difference

It is obvious to any parent who does not live with his or her child that travel time makes a big difference of how often and how long a child will visit. This is so important that very often a stipulation is included in the original child custody agreement that a parent cannot move 20 miles or more away from the other parent. A distance greater than that and visitation with the child can become burdensome for both the parent and the child.

Even when both parents are working hard to maintain the child's relationship with each parent, there may be situations in which it is a real advantage to one parent to move outside the agreed-upon geographic area. If you want to relocate with your child you will need to inform the other parent and the court, and you will need to seek a change in your child custody and visitation order.

What Is in the Best Interest of Your Child?

The family court judge wants to ensure that your child's important family relationships and daily routines are interrupted as little as possible. In order to approve a request to relocate with a child, the judge will consider what is in the best interest of the child. That may or may not be what is in the best interest of the parent. The judge may consider factors such as:

  • How the move will affect visitation with the noncustodial parent
  • The child's educational needs
  • Whether the child has existing strong relationships with extended family that would be hurt with a move
  • The quality of the relationship each parent has with the child
  • The financial ability of the parents to maintain visitation over a greater distance

Your attorney will be critical in helping you build an effective case for relocation or a change of custody so the child does not move away. We also welcome the opportunity to help same-sex couples with these types of relocation issues using the Marriage Equality Act that expands partnership and matrimonial rights.
